IN EARLY JUNE, PHILIPPINE PRESIDENT RODRIGO DUTERTE DEEMED THE ANTI TERRORISM BILL AS URGENT//PAVING THE WAY FOR ITS SWIFT PASSAGE THROUGH CONGRESS. THE BILL IS TOUTED TO BE A STRONG RESPONSE TO TERRORISM// AND IS NEEDED IN THESE MODERN TIMES. CRITICS OF THE LAW SAY THAT THE TIMING, ITS URGENCY DURING THE COVID-19 CRISIS/ AND ITS POTENTIAL FOR MISUSE BY AUTHORITIES// MAKE IT A STEPPING STONE FOR POTENTIAL ABUSE OF BASIC RIGHTS.
THE PHILIPPINES HAS FACED CHALLENGES WITH THREATS OF INSURGENCIES—-FROM ISLAMISTS IN THE SOUTH, THE COUNTRY HAS ALSO FACED DECADES LONG FIGHTS WITH COMMUNIST REBELS///ALSO KNOWN AS THE COMMUNIST PARTY OF THE PHILIPPINES.

IN A VIDEO INTERVIEW RELEASED BY SENATOR PANFILO LACSON’S OFFICE, HE ADDRESSED QUESTIONS FROM MULTIPLE REPORTERS FROM DIFFERENT MEDIA OUTLETS CONCERNING THE BILL THAT HE ORIGINALLY AUTHORED.
-INSERT LACSON 01
https://youtu.be/QxPj0sZrWM0
SENATOR LACSON REITERATED THAT THE LAW HAS SAFEGUARDS AGAINST ABUSIVE IMPLEMENTATION, WHICH INCLUDES WRONGFUL ARRESTS, UNLAWFUL DETENTION AND, ABUSE OF WIRETAPPING AND SURVEILLANCE.
INSERT LACSON 02
SENATOR LACSON STATED THAT THE DEFINITION OF THE LAW IS CLEAR///THAT ANY ASSEMBLY, LABOR STRIKE, VOICES OF DISSENT AND EVEN CURSING AT THE PRESIDENT DOES NOT FALL UNDER THIS LAW.
TO HELP US BETTER UNDERSTAND THE ANTI-TERRORISM BILL, SHOW PRODUCER JAB BUHAY INTERVIEWED ATTORNEY ADONIS GABRIEL, A CONSTITUTIONAL LAW PROFESSOR FROM THE SAN BEDA UNIVERSITY COLLEGE OF LAW.
- INSERT AUDIO PACKAGE
WHEN SIGNED INTO LAW, THIS WILL CREATE AN ANTI-TERRORISM COUNCIL///
THAT WOULD PERMIT LAW ENFORCEMENT TO ARREST AND DESIGNATE PEOPLE AS “TERRORISTS” WITHOUT A WARRANT.
UNDER THE LAW, THOSE CONVICTED OF TERRORISM WILL FACE UP TO LIFE IN PRISON WITHOUT PAROLE. IT ALSO DEFINES TERRORISM AS IT APPLIES TO INDIVIDUALS AND GROUPS WHEN HE OR SHE “ENGAGES IN ACTS INTENDED TO CAUSE DEATH OR SERIOUS BODILY INJURY TO ANY PERSON OR CAUSE EXTENSIVE DAMAGE TO PROPERTY IN ORDER TO CREATE AN ATMOSPHERE OR SPREAD A MESSAGE OF FEAR”.
ATTORNEY GABRIEL EXPLAINS THAT THERE ARE EXISTING LAWS THAT ALLOW LAW ENFORCEMENT TO DETAIN AND ARREST ANYONE/ SUSPECTED TO HAVE COMMITTED AN ACT PROHIBITED BY THE BILL. HE ALSO FURTHER DISCUSSES THE DIFFERENCE BETWEEN BEING A SUBJECT OF SURVEILLANCE UNDER THE CURRENT LAW
VS.THE NEW LAW.
ATTY GABRIEL ALSO EXPRESSES THAT UNDER THE BILL, THE ANTI TERRORISM COUNCIL CAN APPLY FOR AN AUTHORITY FROM THE COURT OF APPEALS TO CONDUCT SURVEILLANCE ACTIVITIES ON A PERSON SUSPECTED OF TERRORIST ACTIVITY. HE FURTHER SAID THAT THIS AUTHORITY ALREADY EXISTS IN THE HUMAN SECURITY ACT, AND THAT THE DIFFERENCE IS ON THE PERIOD OF SURVEILLANCE. THE SURVEILLANCE PERIOD WILL NOW BE EXTENDED FROM THIRTY DAYS TO 60 DAYS, RENEWABLE FOR ANOTHER 30 DAYS.
GABRIEL ADDS THAT THE ALARMING PART OF THE BILL, IS THE LACK OF KNOWLEDGE ON THE PART OF THE SUBJECT OF THE SURVEILLANCE. UNDER THE CURRENT LAW, THE HUMAN SECURITY ACT, THE LAW ENFORCEMENT CONDUCTING THE SURVEILLANCE MUST FILE THE NECESSARY CRIMINAL COMPLAINT AFTER A PERIOD OF 30 DAYS. IF A COMPLAINT IS NOT FILED, THE SUBJECT WILL BE INFORMED THAT HE WAS UNDER SURVEILLANCE AND UNDER THE LAW, THERE IS A REMEDY FOR ALL RECORDS TO BE SUBSEQUENTLY DESTROYED.
UNDER THE NEW BILL THE SUBJECT WILL KNOW THAT HE WAS UNDER SURVEILLANCE ONCE A CASE IS FILED. IF NO CASE IS FILED, HE OR SHE WILL NEVER KNOW. ALL THE RECORDS COLLECTED WILL BE STORED IN THE COURT OF APPEALS.
- SURVEILANCE
-
ACCORDING TO GABRIEL, UNDER THE PROPOSED ANTI-TERRORISM BILL, THE SUBJECT
OF SURVAYLLANCE, WILL ONLY LEARN THAT HIS OR HER PRIVATE COMMUNICATION HAS
BEEN INTERFERED WITH// BY THE GOVERNMENT ONLY WHEN THE CASE IS FILED. IF NO CASE IS FILED, THE SUBJECT WILL NEVER KNOW THAT HE OR SHE WAS UNDER SURVAYLANCE. THE RECORDS OF ALL FORMS OF COMMUNICATION// WILL BE STORED IN THE COURT OF APPEALS.
WHEN ASKED OF HIS THOUGHTS ABOUT THE ANTI-TERRORISM BILL, ATTY GABRIEL EXPRESSED THIS CONCERN:BOUT RATHER THEY SHOULD BE MORE WORRIED ABOUR THE ADMINISTRATION WHO WILL CARRY OUT THE LAW HE SAID

PHILIPPINE INDEPENDENCE DAY
Today is Philippine Independence Day
On June 12, 1898, 122 years ago, the Philippines declared independence from Spain.
On this day, the first president of the young Philippine Republic, General
Emilio Aguinaldo, proclaimed Philippine independence from over 300 years of Spanish rule.
In 1896, the Philippine revolution began.
Heroes like Andres Bonifacio, Emilio Jacinto, among others, formed the Katipunan to revolt against the Spanish colonizers. The Cry of Pugad Lawin signaled the beginning of the revolution.
Later in 1898, even with the proclamation being ratified by the Malolos Congress, the country failed to gain recognition internationally.
Shortly thereafter, the Spanish government ceded the Philippine Archipelago to the United States in the 1898 Treaty of Paris.
On July 4, 1946, the Philippines was granted independence by the United States.
The date was chosen to correspond with the US Independence Day.
On May 12, 1962, President Diosdado Macapagal Arroyo issued presidential proclamation No.28,which declared June 12 a special public holiday throughout the Philippines.
That concludes the first episode of our show on this day June 12, 2020. I’m Chinggay Andrada thanks for listening, see you all next week right here
